Government Action

"Education Management Corporation (EDMC), owns and operates Brown Mackie College in several American cities.  The United States Department of Justice (DOJ) has intervened in a federal lawsuit against EDMC according to an August 8, 2011 DOJ press release.  EDMC has asserted that the pursuit of this lawsuit by the federal government and several states is 'flat-out wrong.'
 "The “whistle blower” lawsuit, filed by a former employee and joined by a second former employee, claims that Brown Mackie paid incentive-based compensation to its admissions recruiters in violation of federal laws against the practice.  The federal prohibitions are intended to stop the practice of paying bonuses and commissions to recruiters based solely on the number of students they enroll. 
"The suit further claims that the effect of the outlawed compensation scheme was the enrollment of large numbers of unqualified students.  They did not complete programs, then later defaulted on federally guaranteed student financial aid.  The defaults caused the federal treasury to lose an alleged $11 billion in federal tax dollars by paying EDMC in response to false claims.
 "If the DOJ proves its case the federal government can recover three times its damages plus a penalty of $5,500 to $11,000 per claim.  The two “whistle blower” plaintiffs can collect a share of 15 to 25 per cent of the United States’ recovery.
 "As of this writing, in early 2012, the suit has not been finally resolved."
