Complaint
I have several grievances with Home Pride Properties. In 2000, we thought we sold our home to Home Pride Properties (at that time they were called Thinking Capital) through a seller financed trust agreement transaction. I was too naive and suffering a personal tragedy at the time to notice the many devious clauses and conditions of the trust agreement. We needed to sell the property on a short timeline and they proposed what seemed like a good offer. In general, they were to maintain the property and make payments on the mortgage secured by my credit until the property was formally sold and financed by a new buyer. To cover their costs during this time they were to rent and manage the property to potential buyers. However, Home Pride failed to meet their obligations. In 2009 they allowed the mortgage in my name go into foreclosure. In order to repair my credit, I was forced by Home Pride to submit a hardship request and get the mortgage modified to prevent the property from being reposed through foreclosure. So currently the property has not sold and a trustee of Home Pride Properties,************* still holds the title to the property. In December of 2012, we asked to terminate our trust agreement and return of the property and title. At that time Home Pride decided to stop making the mortgage payments and revealed a second security deed in the amount of $50,000. They have been unable to explain how the $50,000 was used. In January, they abandoned possession of the property but not the title. The home required over $5,000 in repairs when we acquired possession of the property. For the past two years weve attempted to negotiate terms for terminating our trust agreement. A month ago we finally agreed to all their terms but they have failed to execute the termination of the trust agreement. Instead, they offered a completely unacceptable short sale option. When that was rejected two weeks ago, they have failed to return multiple communication attempts.

Desired Settlement
We are asking the BBB to investigate the business practices of Home Pride Properties and to aid in getting the trust agreement terminated.We are not their only victims. Many of their clients have lost their homes through foreclosure due to their mismanagement. Yet they continue to operate on the credit of their clients with the luxury of an A+ BBB rating. Many details were omitted from complaint due to space limits.

In response, our attorney responded directly to Mr. ********* regarding a resolution to this matter last week. Our attorney is now awaiting Mr. *********'s response so that this can be resolved.

I have not received anything from Home Pride or their attorney as stated by Ms.******.

Final Business Response
We are disappointed that several of the claims made by the consumer are misstated or patently false.

Nevertheless, several attempts and offers have been made to resolve the consumer's concerns -- including extinguishing the debt that encumbers the property and relieving the consumer of any obligation for it. At this time, the parties are awaiting a response from the consumer to the options outlined in writing by counsel last month.

Their offer involves a short sale of the property with no guarantee or other protections of my credit. Also, I responded to their counsels letter by requesting the terms and conditions of the second security lien on the property. They have not responded to that request for additional information.
