What is BBB Advertising Review?
BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims come to our attention from our internal review of advertising, consumer complaints and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
What government actions does BBB report on?
BBB reports on known significant government actions involving business' marketplace conduct.
On December 23, 2009 The business named Earthlink, Inc has entered into an Assurance of Voluntary Compliance. The company is incorporated under the laws of Delaware. The principal place of business in Georgia is located at 1375 Peachtree st. Level A Atlanta, GA 30309. This address serves as a base of operations for the business internet service provider and company website "Earthlink.net".
It is alleged the business has engaged in unfair or deceptive acts or practices in consumer transactions and practices in trade or commerce. Specifically it is alleged the business has:
1. In violation engaged in acts or practices that are in contravention of the of the June 2005 Assurance of Voluntary Compliance.
The business agrees to the following:
1. The phrase "clear and conspicuous or clearly and conspicuously shall mean with the respect and content and representations in business advertising or marketing materials.
2.The font size or shade that they are reasonably readable and reasonably unavoidable by the consumer and are located in close proximity to the represantations which they qualify. If on a website the same size font type that is used in the main body of pages content
3. If disseminated audibly it shall be played at the same decimal level and at the same pace.
4. The business continues to make every reasonable effort to maintain in compliance with the requirements of said agreement.
5. Continue to develop and implement a set of written polices and procedures.
6.Establish advertising guidelines that are reviewed by each principal, officer, director and employee.
7. Establish Sales Guidelines and ensure all persons acting on behalf of the company in any sales, customer service, or sales related position to affirmatively disclose all material that is subject to the transaction.
The business shall pay the following:
1. A filing fee of $82.50
2. For administrative and investigative cost $40,000.
The business expressly denies that it has violated the provisions of the prior Assurance.
This Assurance of Voluntary Compliance shall not be considered and admission of guilt, but enters into this supplemental Assurance of Voluntary Compliance in order to resolve the matter without formal legal action.
