Complaint
After a tornado damaged some of my rental properties in ***** ** Feb.2013 I was approached by a rep. with ProClaims of Atlanta GA. I agreed to sign a contract with them for their public adjusting services. I was told that the fee was 30% of all new money. At the time I signed the contract there was no paper contract there was simply an ipad that I signed with my finger. I did not get a copy of that contract and was told one would be sent to me, which it never was. After ten months proclaim did settle one of my claims and sent me a check for 50% not 70%. When I asked the owner ******* ****** about the additional 20% due to me he told me that it would be mailed out that week. I asked for a copy of my contract which was sent via email. I noticed immediately that the fee had been changed electronically from 30% to 50%. This made me very upset and I asked Mr. ****** about this in which he simply played it off and assured me that the check for the additional 20% was on the way. I then asked for a copy of another contract I signed with them and it had been changed as well. At this time I decided to quit working with this company. The contract states that if Appraisal had already been invoked then I would still owe proclaim for their services on the claim they were still working on. I asked Mr. ****** if appraisal had been invoked and he lied and told me that it had. Appraisal has never been invoked. this was confirmed by the adjuster for the insurance company. Mr. ****** knew if appraisal had been invoked then I could not get out of the contract. To this date I still have not received the additional 20% fee held out from my proceeds even though Mr. ****** has told me via email on four different occasions that the check was in the mail. I have Several Issues here. My contract was changed digitally. I have been lied to several times regarding payment and apprasial invokement. And their web site says a small fee will be charged. 50% is unheard of and should be illegal that they tried to pull this on me

Desired Settlement
I need to receive the 20% Mr. ****** has promised me time and again. Their web site needs to be changed where it says they charge a "small" fee. Instead it should read an actual percentage amount of up to 50% or how ever high they try to charge. And lastly, A lower rating if not expulsion from the BBB. How has this company had 4 complaints with 2 complaints in one year and the BBB still gives them a A- Rating?? There is nothing I have written that I can not prove via email Correspondence.

Business Response
This complaint was filed preemptively, as the claim process was not yet complete and we had not had a chance for both parties to fully disguss the situation. The client has since been paid in full and has agreed to retract this complaint with the BBB. In fact, this client now stated he was pleased with the outcome provided by our company. Any documentation needed for this complaint to be completely removed, I can surely provide. Thank you.

Proclaim company of Timm Valley rd , claimed that they did business with me in June 2013, per Hazared loss for home , as my avocate to work with my adjustor , there was no such services with me . This company Proclaim have intercipted a claim fund check in the amount of $ 2500.00 plus , from my contractor , who did all the repaires to my home , due to water damaged the structure...and Proclaim company have forged my name on claim fund check , and cash the check . I report all info to my mortgage loss department , who said they will try to recover money ( claim check ) also. My mortgage company name ***** *** , ***** ****** **. My mortgae company advide me to send 2 certified letters to Proclaim, requesting funds to be returned to me , that was 2 weeks ago . I have not heard any thing from them, since the request by letter. I also sent the same 2 letters as requested by ***** *** , loss department to mortgage company . what should i do next ?

Desired Settlement
Recovery of $ 2567.82 the refund claim check ,actions for forging my name ,and posting of bad business scam from this Proclaim company in Atlanta ,Ga ,Timms Valley road. WARNING TO PUBLIC OF PROCLAIM'S FALSE ADVERTSISMENT OF HELPING HOME OWNERS IN HADZARD LOSS PER CONSUMERS mortgage companies.

****** ****** signed a contract with our company on 6/3/13 following a pipe burst at **** ****** *** ********** GA XXXXX. Public Adjuster ******* ****** worked diligently on ******** Claim Number XXXXXXXXXXX to increase the claim from its initial payout of $22,410.91. Our company used an Xactimate estimate and communicated with ******* and ******** to make this occur, Ms. ****** was fully aware she was being represented by us and ***** **** ********* *** provided us with a check upon our filing a Conditional Waiver of Lien form. At this time, it is our recommendation that Ms. ****** review the contract she signed with our company again to better understand that we performed a service on her behalf and we were paid by her insurance & mortgage company for those services.
