Closed my small savings acct years ago but continue to receive their/their 3d party (robo-signed by CEO **** ******) junk mail offers which include my personal info such as DOB, etc. Have called at least twice/yr for past 5+ yrs to request their records be updated & my name be removed by PowerCo AND their 3d party entities such as "TruStage." Reception NEVER allows me to speak with anyone and after giving full detail for reason for call, am always put through to various voicemails where I again leave my complete detailed complaint along with a request for callback. I have never rcv'd a callback or confirmation my vm was acted on. I DO, however, continue to receive the junkmail with my personal info included.

Desired Settlement
I would like NO OTHER solicitation from PowerCo or anyone or entity affiliated with PowerCo.
I would like written confirmation from CEO **** ****** that my name has been removed from all solicitation lists of PowerCo AND from any and all PowerCo-affiliated entity(ies).

Dear Ms. *****:

This responds to the letter of concern received from ***** *. ***** directed to the Better Business Bureau, Inc. This is Powerco Federal Credit Union's ("Powerco"), response.

Powerco strives to provide the best customer service possible and we appreciate you reaching out to us with Ms. *****'s concerns. Our records indicate we have an account opened for ***** *. ***** with a balance; however, we have a different address and phone number listed on file from that provided in your correspondence.

It is Powerco's policy to adhere to the member's privacy; therefore, we are limited in the information we can release. Ms. ***** indicated that her "savings account" was closed approximately in 2008. Our records indicate Ms. ***** still has a savings account opened with a balance. However, she did have a checking account closed during the stated time. Currently, this membership account is flagged with an invalid address status due to return mail. If these records were used to return Ms. *****'s call, failed attempts would occur due to invalid contact information on file.

We would be more than happy to address her request. Powerco has privacy policies in place which enables an existing member to opt-out of any marketing materials provided by a third party service provider. The member can visit and under the Education/Privacy Policy section the member can print and complete the opt-out form or remit a request in writing. Any changes to an account must be received in writing with her signature which helps ensure her identity is not compromised.

The "TruStage TM Statement of Benefits" as referenced by Ms. ***** (copy can be provided upon request) does not disclose any of the member's private information including date of birth as referenced as a concern. The statement provides options to purchase additional insurance and provides a deadline date. Our third party service providers adhere to our strict privacy policy.

We were able reached out to Ms. ***** using the contact information you provided in the case letter. Once we confirmed her identity, we were able to properly address all of her concerns. She was surprised to hear that her savings account remains open with a balance. Ms. ***** was very kind and understands now why she continued to receive marketing materials. The checking account was closed, but her savings account was not and this maintained an active status. She indicated there was some mail compromise in her area and did not want any insurance enrollment forms mailed to her from the credit union. She even attempted to stop this process directly with the service provider.

We conducted account file maintenance to prevent further marketing mailings. Ms. ***** will mail or fax her written request to update her address and close out the savings account. We extended our sincere apologies for any misunderstands and encouraged her to remain a member. Although appreciative, she declined since it was difficult for her to visit any of our branches.

In conclusion, thank you for providing Powerco with an opportunity to respond to the concern raised by Ms. *****. We appreciate your attention to this matter and look forward to closure of this administrative concern.
