On September 14, 2011, Morrow Motor Sales, Inc. dba Toyota South, entered into an Assurance of Voluntary Compliance with Georgia's Office of Consumer Protection. The Administrator alleges the company has used, is using, or is about to use unfair or deceptive acts or practices in the conduct of consumer transactions and consumer acts or practices in trade or commerce as declared unlawful by Georgia law.
The Administrator alleges that business has advertised lifetime warranties on new and used vehicles in print and electronic media without adequately disclosing the life to which the representation refers as required by Georgia law. This is a violation of the Governor's Office of Consumer Protection's published Auto Advertising and Sales Practices Enforcement Policies ("the AAEP") and FBPA's general prohibition on unfair and deceptive practices.
The Administrator alleges that business has advertised "free" lifetime warranties on new and used vehicles in violation of Georgia law, which prohibits misrepresenting the sponsorship, approval, characteristics, uses, benefits or quantities of goods and services and the AAEP.
The Administrator alleges that business has advertised lifetime warranties on the Internet in violation of Georgia law, which prohibits using a computer or computer network to engage in any act, practice or course of business that operates or would operate as a deceit or fraud.
The Administrator alleges that business has advertised that vehicles could be purchased for a specific price plus "Doc Fee" (Dealer Documentary Fee) in violation of Georgia law and the AAEP which requires that Dealer Documentary Fees must be included in the advertised price for a vehicle.
Respondent agrees that, effective with the date of acceptance by the Administrator of this Assurance, Respondents and all parties acting in concert shall:
1. Make every effort to comply with the FBPA, the AAEP and related laws.
2. Refrain from advertising lifetime warranties without adequately disclosing the life to which the representation refers.
3. Refrain from using the word "free" in any advertisements for lifetime warranties.
4. Refrain from misrepresenting the source of a service as "factory" when the service is provided by a third party and not the vehicle manufacturer.
5. Refrain from advertising as a warranty any non-factory third party service contract or extended warranty not issued by the vehicle manufacturer.
6. Clearly and conspicuously disclose the scope and limitation of any warranties, extended warranties or service contracts.
7. Refrain from the use of unexplained abbreviations in advertisements.
8. Include all non-governmental fees in the advertised sales prices of vehicles.
