    20. Warranties or Guarantees

    20.4 When advertising “lifetime” warranties or guarantees or similar representations, the advertisement must clearly and conspicuously disclose its intended meaning of the term “lifetime.”

    20.5 Sellers or manufacturers should advertise that a product or service is warranted or guaranteed only if the seller or manufacturer promptly and fully performs its obligations under the warranty or guarantee.

    29. Subjective Puffery Claims

    29.1 Expressions of opinion or personal evaluation of the intangible qualities of a product or service are likely to be considered puffery. Such claims are not subject to the test of truth and accuracy and would not need substantiation.

    29.2 Puffery may include statements such as “best food in the world” and “we try harder” as well as other individual opinions, statements of corporate pride, exaggerations, blustering and boasting statements upon which no reasonable buyer would be justified in relying. Puffery also includes general claims of superiority over comparable products that are so vague that it can be understood as nothing more than a mere expression of opinion.

    29.3 Ultimately, whether any particular statement or claim is puffery will depend upon the context in which it is used in the advertisement.

    I had two different insurance claims for my car. Both claims required separate payment. I took my vehicle to the shop and dropped off the car. After being told the car was being worked on I called about a month later to see what all was left on the car. To my surprise the mechanic told me that they had not even started on the car because they had not received pay. This would normally be okay however, the shop never reached out to my adjuster to see why they had not gotten paid nor did they reach out to me to inform me they hadnt started. Over the course of the next month, after calling and calling I finally called and told the shop not to work on the car as I felt I was being bs and was going to take the car elsewhere. When I got off work that same day I drove to the shop to pick up the vehicle. Only to find out they started work WITHOUT PAYMENT on their own. Meaning the repairs they were doing were not yet covered. After being told they would not hold my car without payment. They then proceed to lie about new fault codes popping up and parts all of a sudden not working. After I finally asked for documentation proof of what repairs and parts were still needed, miraculously my car was finished.(I never received a call saying the car was finished I only knew because I made time to go to the shop that day) after getting my car back turns out the fault code was due to them not reconnecting the lights.

    Magnum Collision is a disreputable shop. The advertise that they are Tesla certified / approved, but in fact, they are not. They gave us an estimate and told us they'd order the parts needed for our car. 6 months later, they finally called and said they had the parts. We took the car in for repairs. It sat there untouched for over a week. They finally took the car apart to start the repairs and found additional damage requiring parts. Imagine my surprise when they told us they could not fix it because they couldn't get the parts. So that tells me the parts they did supposedly get were not even Tesla parts! We struggled to find a shop that would take our disassembled car because Magnum refused to put it back together. Our insurance company refused to pay Magnum because they told our insurance company it would be $1200! They did NOTHING but disassemble the back bumper. We ended up paying out of pocket almost $800 to get our car out of this disgraceful shop. Why they charged us $400 less than they told our insurance company is another mystery, or lie on their part. The people we dealt with were rude and obviously did not care that they lied to us and caused us to be without our vehicle for 3 months (1 at their shop and 2 at another reputable place that actually fixed it). I can't believe they are allowed to operate when they falsely advertise and blatantly lie. Stay far away from this place and save yourself money and time.
