Complaint: My mechanic put one of their remanufactured transmissions in my dodge truck. It began overheating within three days. They have refused to do anything but put a huge burden on my mechanic or myself to get the transmission replaced. We have been battling them for about 18 months.

Desired Settlement: Replacement of the transmission at no cost to me.

Business Response: Initial Business Response /* (1000, 5, 2014/04/17) */ ref: invoice ****** 6/01/12 ******************, Bend OR acct. **** In our discussion with *****'s we were told that the transmission was overheating, but functioning perfectly. Further inquiry led to the conclusion that the cooling system was restricted and that the vehicle was being used in a manner for which the transmission was not designed (ie: running considerable distances off road, uphill and in lower gears). Running considerable distances in lower gears uphill and off road can definitely cause overheating as would a restricted cooling system. We suggested that these other issues be corrected before they cause damage to the transmission. Relevant to this issue the TRANSMISSION EXCHANGE CO. 18 month limited warranty 1. does not cover any part not furnished with the transmission 2. does not cover damage resulting from abuse 3. is limited to defects in the transmission 4. does not cover use for any application other than that for which it was intended. 5. does not allow freight or labor claims after 6 months from date of purchase. The warranty specifies that to make a warranty claim the transmission must be returned to our facility for inspection . Also, please be advised that the transmission sold to *****'s was a rebuilt used part and is therefore not subject to implied warranty of any kind. As we offered *****, the transmission may be returned to our facility where we would be happy to inspect it for defects. However, since the transmission was operating correctly we strongly suggested the these other issues be addressed rather than trying to fix something that is not broken.
