    **************** Law on condominium associations requires that:(1) the condominium association do a reserve study every three years or get an exemption (Revised Code of Washington (RCW) 64.34.392). (2) The law stipulates that this exemption should be renewed every three years through a two-thirds majority vote of the owners. There hasn't been such a vote by homeowners in the Hamlin ***************************** (***) since 2010. Management of ****** ******************* is now assisted by LynnMac Commercial **** which has been working with the board for several years.We are not confident that LynnMac was aware of the legal requirements. ************, Property Manager at LynnMac said Hamlin Shores is not required to get a reserve study. If it does change, and Hamlin Shores does get a Reserve Study (which we recommend), we will most certainly provide it to you. (Source: Email, June 27, 2023). Apparently, Mr. ***** was unaware of the requirement for a vote on an exemption every three years. He did not say a reserve study must be done absent an exemption, only that he recommends it. He should have recommended it a year ago, when the board began planning for an assessment of $75,000 for reserves. If LynnMac had known the requirement for a reserve study exemption, but refrained from informing the *** board it was required every three years, that would be bad enough. If they did not know, that is even worse. In proposing a $75,000 assessment in 2022, they should have planned it on the basis of a reserve study. They did not do a study, Reserves should be based on data from a reserve study. LynnMac offered three choices to the board, $50,000, $75,000 and $100,000. The highest was twice the amount of the lowest, which indicates that they were based on little or no data.Failure to recognize condo legal requirements and/or apply them are grounds for this complaint. LynnMac should refund the assessment and/or resign the account.
