On April 26, 2021, the Commonwealth of Pennsylvania Insurance Commissioner entered into a Consent Order with Trupanion Managers USA, Inc.
The order states it is prohibited for a licensee or an applicant to violate the insurance laws or regulations of the Commonwealth or a subpoena or order of the commissioner or of another state’s insurance commissioner. Respondent entered into Orders with the States of Washington, Louisiana, New York, Vermont, California.
Second, the Order states it is prohibited for a licensee or applicant from knowingly accepting insurance business which was sold, solicited, or negotiated by a person who is not licensed as an insurance producer. Respondent reported to the Department that between January 1, 2010, through December 31, 2016, 1,989 insurance contracts were sold, solicited or negotiated in Pennsylvania by unlicensed employees.
Third, the Order states it prohibits a licensee or an applicant from demonstrating a lack of general fitness, competence, or reliability sufficient to satisfy the Department that the licensee is worthy of licensure. Respondent’s activities described in the Orders with the States of Washington, Louisiana, New York, Vermont, California violate these laws.
Fourth, the Order requires a licensee to report any administrative action taken in another jurisdiction or by another governmental agency within 30 days of the final disposition, to include a copy of the order, consent order or other relevant legal documents. Respondent did not timely report the actions with the State of Louisiana or New York.
Respondent shall pay a civil penalty of $150,000.000.

On August 25, 2021, the State of Vermont Department of Financial Regulation entered into a Stipulation and Consent Order with Trupanion Managers USA, Inc. and American Pet Insurance Company. The Order asserts Trupanion Managers USA, Inc. and American Pet Insurance Company (collectively, the “Respondents”) have violated the terms of the Stipulation and Consent Order dated November 20, 2019. The parties agreed to enter into this Stipulation and Consent order to resolve the violations without further administrative proceedings or litigation.
The Department and Respondents entered into the 2019 Order on November 20, 2019, to settle issues relating to Respondents’ pet insurance producing and claims administration practices in Vermont from the years 2015-2018. As part of the 2019 Order, Respondents agreed to take a number of corrective actions including: (1) Providing the Department a certification, on or before December 31, 2019, that all Vermont pet insurance claims are processed by duly licensed insurance adjusters; and (2) providing the Department, on or before January 31. 2020, with a list of all adjusters who have been duly licensed in Vermont. Respondents failed to provide the Department with the certification that claims are processed only by licensed adjusters and the list of such adjusters within the timeframes set forth in the 2019 Order.
Respondent was fined an administrative penalty of $5,000.
