Complaint: I opened a membership with Vision Quest Fitness in February 2012. It was a 24 month pre-paid membership and was paid in full, in advance, and was valid for any of their locations. They asked for my credit card information for incidental purposes and made a carbon copy of the credit card, saying that they did not have a credit card reader. I changed my job in the middle of 2012 and moved to California for work. As my membership was pre-paid in full, they informed me that they could not refund me when I asked them in person before I left WA. I assumed the membership would expire, and I forget completely about it. I got a call from Vision Quest, Tacoma location, (XXX-XXX-XXXX) at 6:02pm on 03/08/2014. The person left me a voice mail and mentioned that I have a pending bill with Vision Quest. I called them on 03/11/2014 at 12:14 pm and spoke 10 minutes. That person asked for my new credit card info over the phone. I explained to them that I had moved from WA more than 1.5 years ago, and the initial membership was pre-paid for 24 months. There was no reason to continue the membership as 'month-to-month' as that would be 'out of scope' of the initial contract that I had. That guy asked me to come to WA to cancel the membership, and mentioned that the business ownership was changed with change of policy and denied to cancel it over the phone. When I said, that was absurd and that I could not come to WA from CA just to cancel a membership that was 'out of scope' in the first place, they asked me to send a signed letter instead to their Tacoma Location address ***** * **** **** Tacoma, WA, XXXXX). I sent a signed letter as per the conversation on the same day and kept a photocopy for my record. I was assuming the issue got resolved and was taken care of. On 04/16/XXXX X:XX PM, I got a call from Vision Quest, Kirkland Location (XXX-XXX-XXXX), and someone named '*****' asked me to pay again. When I told her about the previous incident, she threatened me to pay the bill else they would send it to a collection agency. When I said that was insane and what they were doing was clearly business 'mal-practice', she said she could not do anything with that being company policy. When I asked why they dis-honored my previous communications and did not close my membership, she refused to answer. When I offered to send the copy of the letter via email she went to talk with the manager. When she returned, she refused to give any email address. Instead, she asked me to call the Tacoma location again. I called the Tacoma Location (XXX-XXX-XXXX) on 04/16/2014 at 7:51 pm. Someone named '***' talked to me. Again, he refused to solve the problem on their side, and said he did not have any authority to cancel the membership. Again, he asked me to visit WA to cancel the membership. When I asked about my letter, he asked me to communicate with their corporate office to cancel the membership and provided me a PO BOX number without any phone number to call Vision Quest, PO BOX XXXXX IRVINE CA XXXXX. He mentioned that they are not allowed to cancel any membership; it has to be done via their Corporate Head Quarter. I googled the address and found that it belongs to LA Fitness Corporate Office. After hours of endless talks over the phone, I felt harassed and stalked by Vision Quest. They are violating the contract and refusing to fix the problem which is on their end. Also, they repeatedly keep trying to charge my expired credit card which has raised a fraud alert with my bank. This isn't a simple matter in which I can fix the issue by paying some amount of money. Vision Quest is actually asking me to go to WA from CA, where I currently reside, to cancel a month-to-month gym membership for which I didn't even sign up, else they would keep charging me, make me defaulter and send it to a collection agency. They have no trouble in asking for my credit card information over the phone, but, for some reason, cannot cancel a membership that I don't even have over the phone. I wonder if they are harassing other people in the same way.
Desired Settlement: I expect Vision Quest to stop harassing me and stop the business mal-practice.
Business Response: Initial Business Response /* (1000, 7, 2014/05/09) */ Member has cancelled their monthly billed membership effective 4/17/14 and no further billing will occur. The past due balance of $37.86 was paid on 4/28/14. No further balance is owed. We apologize for any inconvenience this may have caused. Thank you.
