Complaint: Our kitchen floor was installed by a worker from floors a lot. Our old vinyl was removed and the worker stated sanding underneath with electric sander. At first he was scraping the floor but then he sanded. When he left and I walked out to see the new floor there was dust so thick on everything that you could write your name on every surface in the kitchen and dinning room. I began to clean it up thinking it was sawdust but it was grey and looked weird. So we called **** **** and he said he would send the worker back to clean it up. I said no I want to know what it is and frankly the worker acted odd and was filthy at 9:00 in the morn. when he arrived. We contacted *** ********************** and they came out and took samples and sent them to be annalized. We had to wait 3 days for the results which turned out to be asbestos. My husband called **** **** and he said he would pay to clean our whole house the second thing he said was that we couldn't prove that the asbestos was from the sanding. We had further tests done by NOW, they were done by ********* *****. Asbestos was only found in the areas that were affected by the sanding,Kitchen,dinning room laundry area off of the kitchen. *** ***** checked all of the rooms and the ceilings. **** said his insurance did't cover asbestos, why is that when his business is flooring? I asked about the installers bond and was given the given the same answer about that.Shouldn't his bond take care of anything he ruins? So **** said there was an outfit he had worked with before and they could clean up the asbestos, we wanted a different co. but **** said they didn't clean duct work and he didn't want to pay to have that done separatly. So we said ok to his choice. In the meantime we had moved to a hotel when we found out it was asbestos.The ************ near our house in Puyallup was where we stayed.The guy from the abatement co. came out and looked at the place, he was just a kid but acted like he knew his business. He gave us a date when his team could come out and that was postponed a couple of times. They finally spent two days "cleaning" our house and called us and told us our house was now asbestos free. I spent several minutes being thankful to them on the phone. Well, wasted my breath because when we walked into our "clean" home we saw that they had moved all of the contaminated furniture out of the dinning room and into the living room without thoroughly cleaning it, you could still see the dust on surfaces, and they did a ton of other stuff that just spread the dust to other areas in the house and they didn't clean the heater vents at all. We were so disappointed, we called **** and told him, he called the cleaning people and refused to pay them. **** then told us we would probably have lean put against our home. Why wouldn't it be against his Business, Floors A LOT? We didn't hire them, he did. So we had to have more tests done and this had now cost us several thousands of dollars just because we had the misfortune of buying a new floor from this co. The new set of tests now showed asbestos in the living room and bathroom. **** called us to a meeting at his store where his sister who is part owner was present. He said after talking to his sister,********, he had decided to give us our money back for the floor but not pay for anything else. His sister said we were just after their money. So we said no and left. **** called my husband and said he would give him his money back for the floor and A thousand dollars toward cleaning the place but only if my husband would sign a paper that **** wrote saying we would pay all court costs if it came down to that and if we got ill from the asbestos. My husband signed the paper and got 1900 dollars back. Our house is still contaminated and we are in a rental house but still paying for both homes.We have no savings left. I'm trying to clean what items I can by myself because my husband is a disabled veteran and can hardly walk.We are now out tens of thousands of dollars.I'm almost 67 and this has not been easy as all of our heavy furniture is still in the house and contaminated. I don't feel Floors A LOt should just be able to walk away from this and have an A+ rating.
Desired Settlement: Of course I feel Floors A LOt owes us money but I also feel that the company and it's installers should have to have insurance that covers any type of damage they do to you or your home. My husband and I lived there for three days in the asbestos dust before we knew that that's what it was.The 1000. he gave us for clean up didn't even cover the cost of the tests we had to have done by NOW. A good abatement co. costs about four times that amount. I know we probably will never see a dime but he shouldn't be able to do these things to people's lives. We shouldn't be blackmailed into signing his made up papers in order to get a small check towards the damage that his company did. I had to throw away 602 dollars worth of groceries from our kitchen because our pantry has louvered doors right where he was sanding and the food was covered in asbestos dust. ********, his sister, said it didn't need to be thrown away. She said I was paranoid, would you eat that food or feed it to your grandkids?

WE HAD SCHEDULED INSTALL FOR CUSTOMER ON 9-11-13 & I FOUND OUT LATER FROM INSTALLER THAT THE WEAR LAYER, PATTERN OF VINYL & BACKING HAD BEEN "WALKED" THRU TO SUB-FLOOR & INSTALLER COULD NOT FLOAT OVER ENTIRE FLOOR & INSTALL NEW VINYL! HE HAD TO SCRAPE UP EXISTING VINYL & SAND FLOOR SMOOTH IN ONE SPOT PRIOR TO INSTALL NEW VINYL SO NEW FLOOR WOULD LOOK SMOOTH. PER *****, HE SAID INSTALLER DID A GOOD JOB INSTALLING FLOOR BUT HE WAS DISAPPOINTED AS WAS I WHEN ***** INFORMED ME OF THE DUST THIS CREATED AS INSTALLER SAID HE TOLD ***** BUT NOT HIS WIFE ***** & I SAID TO INSTALLER THAT IN ANY EVENT HE HAD NOT EXPLAINED IN WRITING TO ***** W/ HIS SIGNATURE THAT DUST WOULD OCCUR SO WE NEEDED TO CLEAN IT UP! AS A RESULT OF THIS I IMMEDIATELY OFFERED TO ROGER TO HAVE INSTALLER RETURN TO HOME TO CLEAN UP THIS DUST! ***** IMMEDIATELY SAID HIS WIFE ***** WAS CONCERNED ABOUT ASBESTOS & WANTED INSTALLER TO GIVE BACK VINYL PIECES SO THEY COULD HAVE IT TESTED. I TALKED TO INSTALLER & REMINDED HIM THAT IF WITH EVEN THINK THERE IS ASBESTOS WE ARE SUPPOSE TO HAVE IT TESTED PRIOR TO SANDING & INSTALLER TOLD ME THAT IT "TOOK MANY YEARS TO "WALK THRU" PATTERN TO SUB FLOOR & THAT WITH OVER 20 YEARS EXPERIENCE THAT IS NOT TYPE OF VINYL WITH ASBESTOS & THAT VINYL WAS NOT LAYED OVER ANY OTHER VINYL THAT COULD HAVE CONTAINED ASBESTOS OR HE WOULD HAVE REQUESTED TESTING!" I ASKED INSTALLER TO PLEASE RETURN VINYL SCRAPES TO CUSTOMER SO WE COULD HAVE THEM TESTED WHICH HE DID RIGHT AWAY & I TOLD ***** TESTS WOULD BE PAID FOR @ OUR EXPENSE & THEY CALLED A COMPANY THAT TURNS OUT WE HAVE ACCOUNT WITH CALLED *** *********** ******** TESTS WERE COMPLETED BY *** ********** VERY QUICKLY & VERY QUICKLY & VINYL ADHESIVE & AIR QUALITY ALL CAME BACK NEGATIVE WITH NO ASBESTOS PRESENT. NOW I OFFERED TO PAY FOR HOME TO BE PROFESSIONALLY CLEANED BY **** ******* INSTEAD OF INSTALLER BUT ***** SAID ***** WANTED *** *********** TO SEND DUST BACK EAST TO HAVE IT TESTED EVEN THOUGH THIS COULD TAKE 2-3 WEEKS! WHEN TESTS CAME BACK, ***** SAID DUST HAD ASBESTOS IN IT & TOLD ME THAT HE HOPED THEY DID NOT HAVE TO TAKE LEGAL ACTION & WANTED TO WORK IT OUT WITH THE STORE & THAT HIS WIFE HAD MADE A LIST OF EXPENSES & SUGGESTED I CONTACT MY INSURANCE COMPANY WHICH I DID BUT TOLD ***** ASBESTOS NOT COVERED IN POLICY. I TRIED TO GET COPY OF REPORT FROM *** ************* ******** BUT SHE SAID THAT SINCE ** & ** ******* HAD, (A) MENTIONED LEGAL ACTION & THAT, (B) THEY HAD PAID FOR THE REPORT, SHE COULD NOT GIVE US A COPY OF REPORT WITH OUT SIGNED APPROVAL FROM ****** OR *******! STORE NOW OFFERED TO HAVE HOME CLEANED BY SEPARATE COMPANY THAT DOES ASBESTOS ABATEMENT WORK, BUT SINCE I DID NOT WANT THIS TO GO ON INTO PERPITUITY, THAT I WANTED SIGNATURES FROM ***** & ****** ACKNOWLEGING THAT THOUGH STORE WOULD PAY FOR THIS WORK, THAT THEY WERE A SEPARATE COMPANY & THAT WORK & WARRANTEES ARE FROM THAT COMPANY & A SIGNED AGREMENT WITH COMPANY REGARDING THE SCOPE OF WORK THAT THEY WERE TO DO & PAYMENT UPON COMPLETION OF CUSTOMER SIGNING OFF FOR THIS WORK. I KNOW FROM THE BEGINNING I WANTED TO TAKE CARE OF CUSTOMERS CONCERNS & EXTRA TIME WENT BY NOT WITHIN OUR CONTROL & AFTER CUSTOMER COMPLAINTS REGARDING ******* & CUSTOMER REQUESTING INCREASING EXPENSES, I TOLD ***** THAT I DID NOT WANT TO PROCEED WITH HELPING HIM & ***** UNTIL HE GAVE *** *********** WRITTEN PERMISSION TO GIVE STORE COPY OF ASBESTOS REPORT. ON 11-7-13, ***** SIGNED A "RELEASE OF ASBESTOS REPORT" FORM ALLOWING US TO OFFICIALLY TALK TO ***** ******* @ *** ************ & TO RECEIVE A COPY OF REPORT. WE CALLED & TALKED TO ***** & SHE & REPORT SAID THAT AMOUNTS OF ASBESTOS IN DUST WERE JUST @ OR BELOW DETACTABLE AMOUNTS & NO REGULATORY AMOUNTS HAVE BEEN SET FOR SETTLED DUST. IN ADDITION, SHE SAID, (& REPORT), THAT SINCE NO TEST WAS DONE PRIOR TO INSTALL COULD NOT TELL IF THESE BARELY DETECTABLE AMOUNTS WERE FROM FLOORING REPLACEMENT. SHE SAID THAT SINCE FLOOR & AIR QUALITY WERE TESTED & CAME BACK NEGATIVE OR NON-DETECT, ***** WENT ON TO SAY THAT THE MOST LIKELY SOURCE WAS POPCORN CEILING WHICH WAS TESTED & DETERMINED TO HAVE VERY LOW AMOUNTS OF ASBESTOS FROM CEILING AND MAY HAVE BEEN IN THE HOME FOR SOME PERIOD OF TIME PRIOR TO INSTALL EVER TAKING PLACE. REPORT CONCLUDES THAT IF RESIDENTS OF HOME WOULD LIKE, THEY COULD WET WIPE ALL VERTICAL SURFACES W/ MILD DETERGENT & HEPA VACUMM & LAUNDER ALL FABRICS IN HOME. THIS IS WAY LESS THAN REQUIRED BY AN ABATEMENT TEAM THAT I WAS WILLING TO PAY FOR CUSTOMERS. IN FACT, ABATEMENT TEAM CUSTOMERS NOT HAPPY WITH HAD ALSO SAID THEY WERE WONDERING WHY WE WERE DOING FULL ABATEMENT JOB DUE TO REPORT FROM NOW & THAT IS WASN'T REQUIRED & I TOLD THEM THAT I HAD WANTED TO MAKE CUSTOMER HAPPY & THAT I DID NOT HAVE ACCESS TO REPORT OR PERMISSION TO TALK TO ***** @ *** LIKE THEY ORIGINALLY DID. AFTER REPORT FROM *** ***********, I CALLED BACK ***** & TOLD HIM WE NEEDED TO HAVE MEETING WITH MY PARTNER & HIS WIFE AS UP TO THIS POINT ALL CONVERSATIONS WERE MAINLY WITH ME & *****! AT FIRST ***** DID NOT WANT TO ATTEND BUT FINALLY AGREED. AT THIS MEETING I TRIED TO REMIND ***** & TELL ***** THAT FROM THE BEGINNING I WANTED TO CLEAN UP THE DUST CAUSED BY INSTALLER, WHETHER BY AN ABATEMENT TEAM OR PROFESSIONAL CLEANERS AS STATED IN THIS RESPONSE. I ALSO REMINDED ***** THAT TIME LINES FOR THIS WERE TAKEN OUT OF OUR CONTROL OR NOT CO-ORDINATED WITH US. MY PARTNER ***** ******** TOLD THEM THAT PER ***** & THE REPORT, EVEN THOUGH THE REPORT CANNOT SAY DEFINITEVLEY BECAUSE TEST NOT DONE PRIOR TO INSTALL, BARELY OR NON DETECT AMOUNTS OF ASBESTOS WERE DETECTED IN DUST & WAS FOUND IN CUSTOMERS POPCORN CEILING & MAY HAVE BEEN IN HOME FOR SOME TIME, & THAT VINYL WE WORKED ON DID NOT TEST POSITIVE FOR ASBESTOS & AIR QUALITY DID NOT TEST POSITIVE FOR ASBESTOS & MOST LIKELY SOURCE OF BARELY DETACTABLE ASBESTOS CAME FROM CEILIMG & REPORT STATES CAN CLEAN ALL VERTICAL SURFACES W/ MILD DETERGENT & HEPA VACUMM & LAUNDER ALL FABRICS ALL OF WHICH WE WOULD HAVE BEEN MORE THAN WILLING TO DO FOR CUSTOMER & ALSO TO PAY FOR PROFESSIONAL MAID SERVICE TO CLEAN ENTIRE HOME BUT CUSTOMER DID NOT SHARE @ 1ST THIS INFO. ****** OFFER FOR COMPENSATION WAS TO REFUND ALL MONEY PAID FOR THIS INSTAL & ANOTHER $1000 FOR TOTALL OF OVER $1900.
