Complaint: *** ***** failed to follow through or investigate a reaffirmation of our home with ***** ***** Mortgage during the bankruptcy. Due to his failure we cannot refinance the property and as I understand it we are simply renters with all the expense and none of the benefits. His error in this matter is and has cost us dearly. I've talked with *** ***** and he takes no responsibility for this error, I've written to the Bar Association to complain and learned they will take no action as attorneys cannot be held responsible for poor judgment.
Desired Settlement: We need the bankruptcy reopened according to ***** ***** Mortgage and Bankruptcy departments so we can request the paperwork to have the house reaffirmed. **** ***** has stated clearly this is the only way they will allow us to reaffirm the house; they will not and do not accept any responsibility for not informing our attorney *** *****; they insist it is and was his job/responsibility/duty to know how to handle a reaffirmation mortgage agreement.
Business Response: Initial Business Response /* (1010, 12, 2013/07/03) */ I have reviewed the Complaint filed by ***** ******, my former client. I cannot comment about this matter further. The foremost reason is that such comment(s) would require me to divulge attorney/client communications, which would violate existing ethics rules, and your website would make otherwise confidential communications with the ******** a matter of public record. I will not violate this basic tenet of the practice of law as requested by your organization. In addition, with regard to the relief requested by the *******, I cannot take any further action on my former client's behalf at this time, because they have taken an adverse position to me in this complaint. I cannot proceed with representation because of further ethics issues (even if I chose to do so) if any adverse interest exists. As such, I decline further representation as they have requested, and cannot proceed further with this matter. Final Consumer Response /* (3000, 14, 2013/07/10) */ (The consumer indicated he/she DID NOT accept the response from the business.) To whom it may concern, I cannot accept this glib response from our Attorney, in such a serious matter. The attorney in question has failed to represent us in a timely manner, he failed to protect our home, he failed to make sure we knew about the opportunity to sign a reaffirmation document that would have helped rebuild a financial standing and allowed us to keep our home. Due to his failures we are still faced with a second mortgage, a home that doesn't belong to us; and has hindered our ability to rebuild our lives. This attorney is hiding behind "former client" attorney privilege while acknowledges we are upset with his poor judgment and failure to protect our best interest under the law; this is his poor excuse for not fixing his numerous errors. This attorney has made this mess and I feel like he should out of his own pocket fix it; reopen the bankruptcy case, request the reaffirmation documents for us to sign and protect us from the second. His job was to make sure we were protected as the law allows and he failed on all account. At the very least a full refund should be ordered so we can find a new attorney to clean up his mess. We paid this man in good faith to do for us what we could not do for ourselves and he failed us, left our lives in shambles with no way to resolve his errors.
