Complaint Resolution Log (2)BBB Closure Definitions

Money is owed. **** claims they did work outside the original agreement. I claim they did not meet the terms of the agreement.

Original agreement states clearly, **** will supply all materials and labor. The only re-used material listed is the aluminum siding. The agreement states they will install Windows (plural) and doors, (none were needed). The agreement states new gutters and leaf guards will be installed on the rear section of the house. The agreement states the electrical work will only consist of removing wiring back to the boxes.
The agreement was to put new roof on the entire house after the two rooms and the side porch were removed. There was no part of the house not to receive a new roof.

**** charges me an additional $575.00 for the front porch roof and electrical boxes. I protested this charge face to face with ****** ****. He agreed it was in error and said, " I will have it removed so it doesn't go to collection", quote. He shook my hand on it. Now **** says the $575.00 is for additional leaf guards, a window and wiring.
My position is this: **** did not fullfill the terms of the agreement. I was charges for two new windows and received one. I was charged for new gutters and they reused the old ones. The "wiring" they refer to was simply cutting the old porch light wires and putting them in a box and switch receptacle. This was spelled out in the original agreement, it is not additional work. There are no additional leaf guards except for a couple cylindrical screens used in the downspot. These are about 3 bucks at Lowe's.
It takes several phone calls and /or emails to get any kind of response from ****. Whenever I do contact someone I usually hear, "this is the first I heard of it". I'm really getting tired of that. I paid $28,120.00 for the work. **** fell short in completeing the job as specified. **** is trying to charge me for what the call addition work. Nothing could be farther from the truth. They owe me , I figure about $200.00 reimbursement for one new window and new gutters I was charged for but did nor receive. In addition, I have asked at least three time for a simple letterhead statement to ********* insurance stating they have completed the work so I can get my insurance money. I have much, much more work to do on this house, ****** **** told me I was a good customer and would like to quote on the ather jobs to do. How **** handles this complaint will determine that.

Desired Settlement
$200.00 refund for stated shortcomings in materials and a letter to Westfield Ins. so I can receive my money. Remove the bogus $575.00 charge for "additional work".

Bell construction roofed my house . The awning they roofed leaked next to 2nd story bedroom wall. It rotted 1 roof rafter under the awning. It also rotted the end of the beam that holds the 2nd story bedroom.

Desired Settlement
Fix the beam, replace the roof rafter, and stop the leak.

Business Response
Please review our response and documentation regarding this complaint. This customer's complaint is unfounded and should not be posted in our BBB file, be held against us, or affect our rating. We value and take pride in taking care of our customers. You will see by the documentation provided, that we responded professionally, in a timely manner, and researched the issue for all details. The issue was not brought to our attention until years after the work was performed, and was outside the scope of work and contract we were hired for.

Consumer Response
II never received a written responce from Bell Construction. I was not happy with the phone conversation as It was their responsibility to correct the problem that occured from a place they left unsealed and not shingled. I own the house and hired Bell Construction to do a job that resulted in structual damage. How much time I spend in the house has nothing to do with it. The fact is they are not going to fix the problem. You would think a professional roofing of your home would be warrantied longer than two years. It isn't professional to treat a customer for an $8000 job in this manner but they got paid and i got took. This has really been a costly unpleasant deal for me. As a handicapped person I really feel taken advantage of.
